Member Account, Password and Security: You are responsible for maintaining the confidentiality of your password and account and are fully responsible for all activities that occur under your account. You agree to immediately notify Analyz.ai of any unauthorized use.

User Submission and Contact Information: Submitting your name, email address, organization details, and other information through the Site’s contact forms may be required for Analyz.ai to respond to your inquiry. By providing this data, you acknowledge that Analyz.ai may process it for communication, support, and service updates.

Modifications to Site: Analyz.ai reserves the right to modify or discontinue, temporarily or permanently, the Site (or any part thereof) with or without notice.

 

Conditions of Use

Fees, Payments, Trial, and Refund

The fees for accessing Analyz.ai‘s paid offerings (“Membership Fees”) shall be as listed on Analyz.ai’s pricing page. All Membership Fees are, unless expressly stated otherwise, exclusive of all taxes including applicable GST.

Trial Period: Analyz.ai may, at its sole discretion, offer a free trial for certain plans. Unless you cancel before the end of the Trial Period, your membership will automatically convert to a paid membership.

Refunds: You may request a refund of Membership Fees within Seven (7) days of your initial purchase, provided you have not made material use of the paid Services during that period. After the 7-day period, all Membership Fees are strictly non-refundable.

Third-Party Charges: If the services enable you to run or manage data integrations through third-party platforms, you remain solely responsible for all fees owed to such third-party platforms.

 

Intellectual Property Rights

The Site and its content (“Site Content”) are protected by copyright, patent, trademark, trade secret, and other proprietary rights and laws. Except as expressly authorized by Analyz.ai, you agree not to modify, copy, frame, scrape, rent, lease, sell, distribute, or create derivative works based on the Site or Site Content.

The Analyz.ai name and logos are trademarks of Analyz.ai. Nothing in these Terms of Use should be construed as granting any license or right to use any Analyz.ai trademarks without our prior written permission.

Indemnity and Release

Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT ANALYZ.AI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE.

You acknowledge that certain outputs, insights, analytics, predictions, or recommendations generated by the Site may be powered by artificial intelligence or machine learning models. Such outputs are provided for informational purposes only. Analyz.ai does not guarantee the accuracy, completeness, or suitability of any AI-generated output and is not liable for any decisions, actions, losses, or damages resulting from reliance on such output.

 

Dispute Resolution by Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR RIGHTS. Any and all disputes or claims that have arisen or may arise between you and Analyz.ai shall be resolved exclusively through final and binding arbitration, rather than a court, in accordance with the Arbitration and Conciliation Act, 1996.

Pre-arbitration, parties should first attempt to resolve disputes by emailing hemang@analyz.ai. If unsuccessful, a written Notice of Dispute should be sent to: Bhavnagar, Gujarat, India. If Analyz.ai and you do not resolve the claim within sixty (60) calendar days after the Notice is received, either party may commence an arbitration proceeding.

 

Termination

Analyz.ai, in its sole discretion, may suspend or terminate your account or use of the Site for any reason, including without limitation for lack of use or violation of these Terms of Use.

 

General

These Terms of Use constitute the entire agreement between you and Analyz.ai and govern your use of the Site. These Terms of Use will be governed by the laws of India without regard to its conflict of law provisions. With respect to any disputes or claims not subject to arbitration, you and Analyz.ai agree to submit to the personal and exclusive jurisdiction of the courts located within Ahmedabad, Gujarat.
